Terms of service.

These Terms of Service (“Terms”) govern your access to and use of the Kanacapture platform and related services (the “Service”) provided by Kanastruk services conseils inc. (“Kanastruk”, “we”, “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service in accordance with these Terms and any applicable order or subscription plan.

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations.

To use certain features, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must notify us promptly of any unauthorized use of your account or any other breach of security.

Some features of the Service are offered on a subscription basis. Fees, billing cycles, and payment terms will be set out in your applicable order or plan. Unless otherwise stated, fees are non-refundable.

We may change our fees from time to time, and any changes will apply to subsequent billing periods after reasonable notice.

The Service, including all software, content, and trademarks, is owned by Kanastruk or its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights, title, and interest in and to the Service.

You retain all rights to the inventory data, photographs, and other content you submit to the Service (“Your Content”). You grant us a limited license to host, process, and use Your Content solely to provide and improve the Service.

You are responsible for Your Content and for ensuring you have the necessary rights to submit it to the Service.

You agree not to misuse the Service, including by attempting to access it through unauthorized means, interfering with its operation, reverse-engineering it, or using it to store or transmit unlawful, infringing, or harmful material.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by law, Kanastruk will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amounts you paid to us for the Service in the twelve months preceding the claim.

We may suspend or terminate your access to the Service at any time if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service will cease, and we may delete Your Content in accordance with our data retention practices.

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts located in Quebec.

We may update these Terms from time to time. When we do, we will revise the “last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
